請問聚眾鬥毆時我不是在旁觀看我去勸架也有罪嗎

我朋友跟朋友一起大家一起在吃飯有一群人看不慣我朋友的朋友就打起來了

我朋友看到大家都打起來了,就過去勸架要把他們分開

結果我朋友被打受傷了,我朋友後來去報案警察說人都跑掉了所以不了了之

事隔一年後對方反而去報案說我朋友跟他的朋友把他打受傷

他要告我朋友聚眾鬥毆

結果我朋友就被抓走了

請問這樣我朋友有罪嗎
